0ne of the biggest issues that exist with people driving around is that a sizable contingent of motorists do not possess any form of insurance. While states have created legislation to punish those that do not maintain their insurances, many people decide to chance it and drive around without even having the smallest legal form of insurance available. Now, these drivers could be safe and not cause any problem. However, there’s a fairly strong correlation between people that are uninsured and those causing crashes (either through their lack of attention or being intoxicated). There is considerable complexity in an uninsured motorist operating insured vehicle. Of course, the direct driver of the car does not have insurance and it will be difficult to get anything from them (such as getting your car fixed). Additionally, there is a lack of direct responsibility from the person that has purchased insurance for their car. They, of course, were not driving the car at the moment that contributed to the situation. However, there is a bit of indirect responsibility in the sense that the person very likely provided the usage of the car to the person that did cause that action.

What about a car that has been stolen?

Of course, what I have just said does not really make sense if there is a situation where there is a car that ran into a person, but that vehicle had been stolen from the rightful owner. It would be a much harder situation to prove that the insurance company should have to pay out through the policy that the owner purchased for their car for a vehicle that had been stolen. Again, maybe there is some sort of more tortured logic that could work. If the person that owned and has insured the car has failed to keep their car safe – such as leaving the keys in the ignition as they have went back inside – there could be a situation where there is a bit of personal liability. After you have went through a crash caused by an uninsured motorist, make sure to stop by a personal injury attorney that could go through all the facts of the case to see what the next steps should be for you. Heck, maybe there are avenues to getting you damages or your car fixed that I have not even had the time to discuss so far. I’m not a lawyer, so that chance is high.

Our final thoughts

Whenever I drive, there is something in the back of my mind – what if a person crashes into me that does not have active insurance? Aside from any sort of pain and suffering that I am dealing with, I would have to go to a law firm and attempt to get blood from a stone (the uninsured motorist). While I could get some fantastic legal representation, even the best lawyer may struggle to get me restored to full if the person that has ran into me does not work or ends up incarcerated.
